JUSTICE SATYAVRAT VERMA ORAL ORDER 07-01-2022 Heard the learned counsel for the petitioner and the learned APP for the State, through Video Conferencing. The petitioner seeks bail in connection with Guthani P.S. Case No. 163 of 2021, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The learned counsel for the petitioner submits that the petitioner is in custody since 20.07.2021 and charge-sheet has been submitted in this case and allegation is of recovery of 53 litres of liquor and the petitioner was apprehended with his motorcycle.

The learned counsel for the petitioner submits that the petitioner is innocent and came to be implicated in the case based on his antecedent mentioned in para 3 of of the bail application.

Patna High Court CR. MISC. No.56383 of 2021(2) dt.07-01-2022 2/2 Learned A.P.P. opposes the bail application.

Considering the fact that petitioner is in custody since 20.07.2021 and charge-sheet has been submitted, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.5,000/- (Five Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II-cum-Special Judge, Excise, Siwan, in connection with Guthani P.S. Case No. 163 of 2021. The application stands allowed.
