Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Suiya P. S. Case No.51 of 2019, instituted for the offences under Section 399 of the Indian Penal Code and Sections 25(1-b)A, 26 and 35 of the Arms Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 08.04.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case.

The learned counsel for the petitioner submits that the

The learned counsel for the petitioner submits that petitioner was not arrested from the spot and his name came in the confessional statement of co-accused, as such, nothing was recovered from his possession.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent, charge-sheet has been submitted in the case and was not arrested from the spot, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Suiya P. S. Case No.51 of 2019. The application stands allowed.
