Mr. Vaibhav Vishal, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 29-07-2025 Heard learned counsel for the petitioners, learned APP for the State and learned counsel for the informant.

2. The petitioners seek bail in connection with Thali P.S. Case No. 217 of 2024, instituted for the offences punishable under Sections 80, 85, 115(2), 352, 351(3), 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 3/4 of Dowry Prohibition Act.

3. The prosecution case, in short, is that daughter of the informant was done to death by the petitioners along with other co-accused persons for non-fulfillment of dowry.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the

Learned counsel for the petitioners also submits that the petitioners are father-in-law and brother-in-law of the deceased and no specific allegation has been attributed against the petitioners. No dowry has been demanded by the petitioners. It is next submitted that daughter of the informant was undergoing treatment and in course of treatment she died. The petitioners are in custody since 16.04.2025 and have got no criminal antecedent. Learned counsel for the petitioners further submits that similarly situated co-accused i.e. husband of the deceased has been granted regular bail by a Co-ordinate Bench of this Court vide order dated 22.05.2025 passed in Cr. Misc. No. 32699 of 2025.

5. Learned APP for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioners.

6. Considering the aforesaid facts and circumstances of the case and taking into account the period of custody undergone by the petitioners, this Court is inclined to grant bail to the petitioners.

7. Let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Court
