2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 329(4), 109, 303(2), 352, 351(2)(3), 3(5) of the Bharatiya Nyaya Sanhita.

3. As per F.I.R., on 25.1.2026 at about 9 PM, all the named accused persons, including this petitioner, entered the house of informant and co-accused Pintu Yadav assaulted on the head of the husband of informant by means of lathi. It is further alleged that co-accused Kundan Yadav pointed pistol upon the informant and other co-accused persons looted away Rs. 45,000/- cash and ornaments from the house of informant.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Specific

Patna High Court CR. MISC. No.45048 of 2026(2) dt.22-07-2026 2/2 accusation of assault is against other co-accused person and petitioner is only alleged to be member of the mob. Allegation against petitioner is general and omnibus. Case and counter case. Rest of the allegations are ornamental only to make the case grave. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering backdrop of the case, nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bhagalpur in connection with Goradiah P. S. Case No. 23 of 2026, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) Navya/- U T
