Petitioner apprehends his arrest in Bihta P.S. Case No.242 of 2017, registered under Section 394 of the Indian Penal Code.
The informant lodged the case against four unknown persons for robbery of his tractor with trailer. During the course of investigation, two accused persons are said to have confessed their guilt and disclosed that the petitioner had come with the purchasers for purchasing the tractor.
Learned counsel for the petitioner submits that save and except the fact that the petitioner accompanied two persons who too were intending to purchase the tractor from the coaccused, there is nothing on record to show the involvement of the petitioner. The petitioner did not either participate in the
Patna High Court CR. MISC. No.42832 of 2019(2) dt.11-07-2019 2/2 robbery nor purchased the stolen tractor. Petitioner had no knowledge about the fact that the tractor was robbed one. Taking into consideration the facts aforesaid and the fact that the petitioner has got no criminal antecedent, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Danapur, Patna in connection with Bihta P.S. Case No.242 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
