2. The petitioner apprehends her arrest in a case registered for the offence under Sections 406, 409 and 420 of the Indian Penal Code.

3. It is alleged that this petitioner has withdrawn Rs. 1,20,000/- (One Lakh Twenty Thousand) under the Government Scheme of "Prime Minister Awas Yojna (Rural)" in three installments in financial year 2017-18 by giving wrong information to concerned Block Office.

4. It is submitted on behalf of petitioner that petitioner is ready to refund the amount which is allegedly withdrawn by her.

5. Considering the submission of learned counsel for

No.50016 of 2023(2) dt.11-08-2023 2/2 the petitioner that petitioner is ready to refund the government money, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 3, Madhepura in connection with Kumarkhand P.S. Case No. 105/2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that at the time of furnishing bail-bond the petitioner shall deposit Rs. 1,20,000/- (One Lakh Twenty Thousand) through Bank Draft in the learned Court below, failing which, the bail bond of the petitioner shall not be accepted.

6. It is made clear that without going into the merit of the case, the aforesaid order has been passed only for the purpose of grant of bail. The aforesaid payment shall be subject to the final outcome of the case.
