Mr. Binod Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RANJAN KUMAR JHA ORAL ORDER 17-07-2026 Heard learned counsel for the petitioner, learned counsel for the informant, and the learned APP for the State.

2. A Vakalatnama has been filed today in the office on behalf of the informant. Let his appearance be recorded on the record.

3. The petitioner seeks anticipatory bail in connection with Srinagar P.S. Case No. 109 of 2026, registered for the offences punishable under Sections 65(2) and 62 of the B.N.S., 2023, along with Sections 4 and 6 of the Protection of Children from Sexual Offences (POCSO) Act.

4. The allegation against the petitioner is of sexual abuse committed upon an eight-year-old minor girl.

5. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.45538 of 2026(2) dt.17-07-2026 2/2 petitioner has been falsely implicated in this case due to local rivalry and that there is an inordinate delay of 3 days in lodging the FIR.

6. Learned APP for the State, assisted by the learned counsel for the informant, vehemently opposes the prayer for anticipatory bail, submitting that there are specific and serious allegations of sexual assault against the minor victim child.

7. Looking at the gravity and serious nature of the allegations involving the sexual abuse of an eight-year-old minor girl, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner.

8. Accordingly, the prayer for anticipatory bail of the petitioner stands rejected.
