JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 02-08-2016 Heard Mr. Dharnidhar Mishra, the counsel for the petitioner and Mr. Vinay Kriti Singh, the counsel for the State. The petitioner claims himself as the Village head and raises a grievance against a proposal to construct the Panchayati Sarkar Bhawan on the land made available by the Mukhiya of the Malaur Panchayat (respondent no. 8). He has drawn attention of the Court to notice issued in this regard by the Government (Annexure-1). It is stated that the Panchayat Sarkar Bhawan is to be constructed in and around the headquarter of the Panchayat. The said notice (Annexure-1) is addressed to the District
Patna High Court CWJC No.2496 of 2014 (2) dt.02-08-2016 2/2 Magistrate of all the districts.
On a query, Mr. Mishra states that till date the respondent(s) have not commenced the construction work of the Panchayat Sarkar Bhawan. In my view, where the Panchayat Sarkar Bhawan for a Panchayat shall be constructed is purely an administrative decision of the respondents-State. This Court in such matter cannot invoke its writ jurisdiction. The petitioner may agitate his grievance before the District Magistrate, who may be empowered to effect change in the location of the Panchayat Sarkar Bhawan, if need be.
Let the petitioner ventilate his grievance before the respondent-District Magistrate.
If any such representation/application is filed, I am sure, the same shall receive due consideration and disposal at the hands of the concerned respondents in accordance with law. (Kishore Kumar Mandal, J) rohit/- U
