The petitioners apprehend their arrest in Jamui P.S. Case No. 03/2017, registered for the offences punishable under Section 7 of the E.C. Act.
Petitioner no. 1 is driver of the vehicle bearing registration no. BR 46 7750 and petitioner no. 2 is owner of the rice loaded on the vehicle.
Learned counsel for the petitioners submits that petitioner no. 2 purchased rice from the market and he was carrying the same on the vehicle of petitioner no. 1. Vijay Saw @ Vijay Sah has already been granted anticipatory bail vide order dated 21.04.2017 passed in Cr. Misc. No. 17542/2017. Case of the
Patna High Court Cr.Misc. No.26056 of 2017 (2) dt.07-07-2017 2/2 petitioners stands on the same footing.
Considering the facts aforesaid and the fact that petitioners were not carrying the foodgrains after purchasing from black-market, the petitioner, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Jamui in connection with Jamui P.S. Case No. 03/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
