The petitioners have preferred this application for grant of regular bail in connection with a case registered under sections 272, 273, 414 and 34 of the Indian Penal Code and sections 30(a), 41 and 56(c) of the Bihar Prohibition and Excise Act, 2016.
As per allegations in the F.I.R, 728 litres of illicit liquor was recovered from the two vehicles parked near the line hotel and it is stated that the accused persons including the petitioners herein were taken into custody.
Patna High Court CR. MISC. No.9912 of 2021(4) dt.23-08-2021 2/2 It is submitted by learned counsel for the petitioners that they have been falsely implicated in the case. No incriminating article has been recovered from their possession. They have no concern with the seized liquor. They are in custody since 7.10.2020 and have no criminal antecedent. Investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the petitioners not having any criminal antecedent together with their having remained in custody for over 10 months, the Court directs the petitioners to be enlarged on bail in connection with Gaighat P.S. Case no. 319 of 2020 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur.
