The petitioner seeks bail in Katoriya (Suiya) P.S. Case No. 270"A" of 2016, registered for the offence under Section 395 of the Indian Penal Code.

As per the prosecution case, 18-19 unknown miscreants assaulted the informant, who is Munsi of a construction company, and threatened him of dire consequences if he contacts with anyone on phone and thereafter, they also snatched mobile, purse and Aadhar Card of the informant and his companions.

It is submitted on behalf of petitioner that name of the petitioner transpired during course of investigation in the confessional statement of co-accused Ghanshyam Yadav and

Patna High Court CR. MISC. No.57113 of 2021(2) dt.31-01-2022 2/2 Prakash Yadav, who have already been granted bail by this Court, vide order dated 27.03.2017 passed in Cr.Misc. No. 54266 of 2016 alongwith connected Cr.Misc. No. 55281 of 2016. Petitioner is in custody since 05.07.2019. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Katoriya (Suiya) P.S. Case No. 270"A" of 2016.
