In this case, the petitioner is seeking relief from this Court to direct the respondents to allow him to appear in the medical test as he has qualified in the written and physical test, but could not appear in the medical test on account of the fact that at the relevant time he was posted as Sub-Inspector in the C.I.S.F. 3.
The present matter relates to appointment of Sub Inspector of Bihar Police. The examination was conducted in the year 2004 and the petitioner approached this Court in the year 2013. There is a big gap of 12 years in approaching this Court. From the counter affidavit it reflects that the notices were served upon the
Patna High Court CWJC No.9961 of 2013 dt.25-07-2016 2/2 petitioner for medical test, but he did not appear. 4.
Be that as it may, it will not be equitable to ask the respondents to allow the petitioner to appear in the medical test in a situation when the petitioner is already serving in Para Military Force of the Union of India and already discharging the duty for quite a long time. He must feel satisfied wherever he has been placed and after completing 12 years service, there is no justification for getting an entry in the service of the State Government. 5.
In such view of the matter, this Court does not find any merit in the present petition. Accordingly, this writ petition is dismissed.
