The petitioner is apprehending his arrest in connection with Buxar P.S.Case no.41 of 2016 dated 6.2.2016 , registered for offences punishable under Sections 467, 468, 471, 472, 420, 409, 34/419 of the Indian Penal Code.
Allegation against the petitioner as per FIR against the petitioner, who was loan officer of the Bank of Baroda , Buxar, is of sanctiong a loan of Rs.23,50,000/- to Baby Shukla and Devendra Shukla for the purpose of purchase of a Truck and at that time one Manoj Kumar was Manager of the Bank and the sanctioning authority. It further appears from the FIR that the Truck was never purchased.

No.59637 of 2018(6) dt.08-04-2019 2/3 Submission of the learned counsel for the petitioner is that she is only a loan officer and the responsibility to verify the same and sanctioning the same is on the Manager and as to whether the Truck has been purchased or not is responsibility of the Manager, which will also appear from the materials collected during the course of investigation and that Manoj Kumar has already been granted privilege of anticipatory bail by a Co-ordinate Bench of this Court, vide order dated 10.5.2018 passed in Cr. Misc. No.17007 of 2018 and co-accused Baby Shukla against whom the loan has been granted, has also been granted privilege of anticipatory bail, vide order dated 7.2.2017 passed in Cr Misc. No.12215 of 2016.

Having heard both sides and in view of the facts and circumstances, as stated above, and also considering the fact that the petitioner is a lady , let the petitioner surrender before the court below within a period of six weeks from the date of order and on surrender he will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Buxar in connection with Buxar P.S.Case No.41 of 2016 dated 6.2.2016, subject to condition as laid down under Section
Patna High Court CR. MISC. No.59637 of 2018(6) dt.08-04-2019 3/3 438 (2) of the Code of Criminal Procedure, with further condition that she has to co-operate in the investigation of the case and she will also appear before the police as and when required by them.
With the aforesaid observation, this application is allowed.
