1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Barauni Rail P.S. Case No. 69 of 2023 dated 26.03.2023 registered for the offence(s) punishable under Section(s) 401, 414/34 of the Indian Penal Code.

3. The main submissions advanced by the learned counsel for the petitioner are that FIR was registered against seven accused persons including the petitioner and as per the allegation co-accused Anil Kumar Sah @ Anil Shaw was apprehended at the spot who revealed the name of this petitioner and other co-accused persons and the said co-accused Anil Kumar Sah @ Anil Shaw has been granted bail by a co-ordinate Bench of this Court vide order passed in Cr. Misc. No.40056 of

Patna High Court CR. MISC. No.47752 of 2023(2) dt.02-08-2023 2/2 2023. Further submissions are that another co-accused, namely, Rajiv Kumar, carrying similar nature of allegation, has also been granted bail by a co-ordinate Bench of this Court vide order passed in Cr. Misc. No.37633 of 2023, petitioner was arrested from his house and from his possession only one piece of blade was recovered and against him there is criminal antecedent of one case in which he is on bail and in the present matter he has been languishing in jail since 28.03.2023 and against him, the investigation has been completed.

4. Learned APP appearing for the State has opposed the bail prayer.

Considering the above submissions and mainly taking into account the custody period of the petitioner as well as completion of investigation against him, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail in connection with Barauni Rail P.S. Case No. 69 of 2023 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned. (Shailendra Singh, J) Sanjay/- U T
