No one appears on behalf of the State.

The petitioner apprehends his arrest in connection with Tarapur P.S. Case No. 73 of 2016 registered for the offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that in the F.I.R., there are specific allegations against Md. Nehal, son of Md. Kamaluddin, and Sabbir, son of Md. Tanbir. He further submits that so far as the present petitioner is concerned his name is mentioned in the First Information Report without attributing any allegation against him, no specific allegation against the petitioner is made. In the submission of the learned counsel for the petitioner

Patna High Court Cr.Misc. No.31801 of 2017 (2) dt.13-07-2017 2/2 the petitioner deserves privilege of anticipatory bail. In the facts and circumstances of the case, let the petitioner namely Md. Nasim, in the event of his arrest or surrender before the court below within four weeks from today, be enlarged on bail on furnishing bail bond in the sum of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Sri S.K. Singh Judicial Magistrate 1st Class, Munger, in connection with Tarapur P.S. Case No. 73 of 2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. The petitioner shall immediately join investigation and shall report to the Investigating Officer within a week and thereafter as and when required to conclude the investigation at the earliest.
