2. The petitioner is in custody since 08.07.2014 in connection with Bihiya P.S. Case No. 210 of 2013 for the offences alleged under Section 379 of the Indian Penal Code and Section 15(2), 15(4) and 16 of the Petroleum and Minerals Pipe Lines Act.
3. It is submitted that the petitioner has been falsely implicated merely on the basis of confessional statement of coaccused. Similarly situated other co-accused persons have been granted bail by this Court in Cr. Misc. Nos.7564 and 30439 of 2014.
4. Having regard to the entirety of the facts and circumstances of the case, let the petitioner (Gulab Chand Yadav) be released on bail on furnishing bail bond of Rs.10,000/-(ten
Patna High Court Cr.Misc. No.43427 of 2014 (3) dt.04-03-2015 2/2 thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Bihiya P.S. Case No.210 of 2013, subject to the condition that the petitioner shall remain physically present on each and every date during trial and in the event of failure on two consecutive dates, his bail bond shall be liable to be cancelled by the learned Court concerned.
