The petitioner seeks bail in Biraul P. S. Case No. 60 of 2019 instituted for the offence under Section(s) 328, 364, 382, 401/34 and 120B of the Indian Penal Code. Learned counsel for petitioner submits that petitioner is not named in the written report. The name of this petitioner has come during investigation in the statement of owner of the vehicle, namely Raj Kishore Jha who has stated that he has identified the petitioner in the petrol pump. Learned counsel for petitioner submits that driver of the vehicle sitting on the vehicle did not identify the petitioner. He has not taken the name of this petitioner. No TIP has been held. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM, Biraul at Benipur, Darbhanga, in connection with in Biraul P. S. Case No. 60 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner.
