====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 22-07-2019 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Ghorasahan P.S. Case No. 124 of 2019, instituted for the offence under Section(s) 461 and 379 of the Indian Penal Code.
It is alleged in the written report that informant is running CSP Customer Service Center in the house of Prabhunandan Prasad situated in village Ghorasahan. On 6.4.2019 the informant withdrew Rs.1,20,000/- through Cheque from SBI Puranhiya Branch, out of which, transaction of Rs.64,000/- was made from the CSP Customer Center on the same day. The remaining amount of Rs. 56,000/- was kept by the informant in the counter. Thereafter, the informant closed

On 8.4.2019 at 9.30 a.m. when he came to open the CSP office, the lock of the CSP office was found broken. He entered into the office and found that some unknown persons after breaking the counter have stolen the entire amount kept therein.
Counsel for the petitioner submits that petitioner is not named in the written report. He was employee of the C.S.P. of Bank of the petitioner and when he demanded his remuneration from the informant, he was threatened. He further submits that petitioner has been falsely implicated in the instant case. There is no identifying mark of the notes in the written report which could tally with the notes recovered from house of the petitioner. There is no signature of petitioner in the seizure list.
Petitioner is in custody since 9.4.2019 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sikrahana at Dhaka, Distt. East
