The petitioner apprehends his arrest in connection with Turkaulia P.S. Case No. 813 of 2015, registered for the offences punishable under Sections 366, 366(A)/34 of the Indian Penal Code.

In the First Information Report, there is allegation against the petitioner and others to have kidnapped the daughter of the informant but in the statement recorded under Section 164 of the Cr.P.C. the victim girl has stated that this case is false, she had performed marriage with the petitioner out of her own sweet will and she is living with him, she has stated her age 19 yeas and the learned Magistrate has assessed her age 20 years. Case No. 813 of 2015, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
