The present petition has been filed for modification of the order dated 22.05.2023 passed in Criminal Misc. No. 47945 of 2022 to the extent of extending the time period granted to the petitioner to surrender before the learned court of Chief Judicial Magistrate, East Champaran at Motihari in connection with Trial No. 1313 of 2022, arising out of Complaint Case No. 432 of 2021, for the purposes of being admitted to the privilege of provisional bail.

The learned counsel for the petitioner has submitted that on account of there being communication gap in between the petitioner and

No.50990 of 2023(2) dt.16-08-2023 2/2 his counsel, the petitioner could not surrender within the time frame fixed by this Court by the aforesaid order dated 22.05.2023, hence a sympathetic view be taken and the time granted to the petitioner to surrender before the learned court below be extended.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for petitioner as also taking into account the averments made in the present petition, I deem it fit and proper to extend the time granted to the petitioner to surrender before the learned court below for the purposes of grant of provisional bail by a further period of four weeks from today. 4.

The petition stands disposed off on the aforesaid terms.
