2. The petitioner seeks bail in Katra (Jaguar O.P.) P.S. Case No. 297 of 2023 registered for the offence punishable under Sections-25(1-b)a, 26 of the Arms Act.

3. Allegedly, one country-made pistol and three live cartridges were recovered from possession of the petitioner.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. Nothing was recovered from his conscious possession. The petitioner is in custody since 27-10-2023.

5. Learned APP has opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.51096 of 2024(2) dt.29-07-2024 2/2 as also the period of custody, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Miss Kumari Savitri, Court No. 7, learned Judicial Magistrate-Ist Class (East), Muzaffarpur in connection with Katra (Jaguar O.P.) P.S. Case No. 297 of 2023 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court.

7. Before accepting the bail bond of the petitioner, the learned court below shall verify the criminal antecedent of the petitioner and if, it is found that he is involved in any other case other than the cases which have been mentioned in paragraph-3 of the petition, his bail bond shall not be accepted.
