The petitioner seeks bail in Rupauli P.S. Case No. 109 of 2012, registered for the offences punishable under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR, nothing has been recovered from the possession of the petitioner. Name of the petitioner figured in the case in the confessional statement of co-accused Srawan Yadav, Babloo Mandal, Kumod Mandal and Jai Singh Mahto. The investigating officer did not collect any tangible evidence to show the involvement of the petitioner, except the fact that the petitioner has got criminal antecedent. Considering the facts aforesaid and the fact that

Patna High Court Cr.Misc. No.41797 of 2014 (3) dt.05-02-2015 except confessional statement there is no material against the petitioner, he is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri S. Gandhi, the learned Judicial Magistrate, 1st Class, Purnea in connection with Rupauli P.S. Case No. 109 of 2012.
