In this application for anticipatory bail the petitioner apprehends his arrest in connection with Barhara P.S. Case No. 320 of 2016 for the offences punishable under sections 147, 148, 149, 341, 323, 307, 504, 506 and 427 of the I.P.C. In the First Information Report there is allegation against the petitioner that he opened fire with his country made pistol upon the informant causing injury in his left palm. Submission is of false implication and that in the injury report no fire arm injury has been found, the petitioner due to the land dispute has been falsely implicated and as such the petitioner deserves sympathetic consideration, other co-accused has been allowed pre-arrest bail by the learned court below itself.
Patna High Court Cr.Misc. No.14303 of 2017 (4) dt.10-07-2017 2/2 The learned A.P.P. after going through the injury report fairly submits that no fire arm injury has been found on the person of the informant.
In the facts and circumstances as stated above, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Bhojpur at Ara in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
