The petitioners seek pre-arrest bail in connection with Hathauri P.S. Case No. 71 of 2019 for the offences alleged under Sections 363 and 366A of the Indian Penal Code. The accusation is that in the early morning of 06.04.2019 informant came to know that his daughter, aged about 17 years, is missing since early preceding night. Thereafter, informant started the search of his daughter and made query from Anjali Devi, who stated that she used to manage the talk of the daughter of the informant with Ravi Kumar Manjhi, who kidnapped his daughter for the purpose of marriage. Informant, further, stated that in the kidnapping of his daughter both the petitioners have also hand. Learned counsel appearing for the petitioners submits that in fact the petitioners are neighbours of the informant and mere on suspicion their names have also been disclosed by the
Patna High Court CR. MISC. No.43954 of 2019(2) dt.17-07-2019 2/2 informant having hand in kidnapping of his daughter. The daughter of the informant moved with Ravi Kumar Manjhi in love affairs, but, with ulterior motive, the names of the petitioners have been implicated in this case. Learned Additional Public Prosecutor for the State opposes the prayer for pre-arrest bail.
Having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Hathauri P.S. Case No. 71 of 2019 shall be released on pre-arrest bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, I, Muzaffarpur, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
