JUSTICE AMARESH KUMAR LAL ORAL ORDER 02-03-2015 Heard the learned counsel for the petitioner and the learned counsel for the State.
2. The petitioner seeks bail in Sessions Trial No.1406/2013 arising out of Dhanarua P.S. Case No.66/2013 registered for the offence punishable under Sections 304B/34 of the Indian Penal Code.
3. It is submitted on behalf of the petitioner that the petitioner is the husband of the deceased and according to the allegation, the deceased was burnt by the petitioner and her inlaws. He is innocent and has committed no offence nor he has criminal antecedent.
4. The allegation against the petitioner is to have set fire on the deceased causing her death during treatment. After
Patna High Court Cr.Misc. No.39733 of 2014 (4) dt.02-03-2015 2/2 investigation, the case has been found true and the case has been committed to the Court of Sessions. The charge has already been framed and the examination of witness is going on as per report submitted by the learned trial court.
5. Considering the facts and circumstances of the case, in my opinion, the petitioner does not deserve bail. His prayer is rejected.
6. The learned trial court is directed to expedite the trial preferably within a year.
