JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-04-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. C-2696 of 2015, disclosing offences under Sections 406, 420 of the Indian Penal Code.

Allegation against the petitioner, who happens to be the relative of the complainant, is that the complainant used to deposit the premium of the insurance amount through the petitioner and later on, he came to know that the two premium have not paid and as such the petitioner has misappropriated the money given by the complainant.

Submission of learned counsel for the petitioner is that there is no chit of paper is available to show that the amount

Heard learned A.P.P. as well as learned counsel for the complainant, they have opposed the prayer for anticipatory bail of the petitioner.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Bhagalpur, in connection with Complaint Case No. C-2696 of 2015, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
