The petitioner, a hapless widow of the erstwhile employee has approached this Court seeking a direction upon the respondent authorities to extend the benefit of 1st ACP to her late husband, Angrahit Ram with effect from 09.08.1999 and 2nd ACP with effect from 31.12.2005 by declaring him passed in basic training in the light of the direction of Additional Director General of Police, Bihar, Patna contained in letter dated 01.07.2008 (Annexure-P/12).

Learned Advocate for the petitioner referring to the averments made in the writ petition has contended that on account of non-completion of the training, her husband has been denied the benefit of 1st and 2nd ACP, in complete disregard to the letter dated 01.07.2008, which clearly stipulates that the constables who have completed arms duty for atleast five years, they shall be treated to have passed in basic training. The husband of the petitioner died long back on 24.08.2007, thereafter the petitioner approached all the authorities concerned, but to no respite, hence the present writ petition.

4. Learned Advocate for the respondents referring to Annexure P/9 submitted that for redressal of the grievance the petitioner has already approached the Superintendent of Police, Khagaria, who is the competent authority and shall look into the matter and take appropriate action.

In view of the fair submission, the present writ petition stands disposed off with a direction to the Superintendent of Police, Khagaria to consider the representation of the petitioner as contained in Annexure P/9 and disposed off by a reasoned and speaking order, preferably within a period of 12 weeks from the date of receipt/production of a copy of this order.

6. Suffice it to observe in case the claim of the petitioner finds favour, necessary consequential order must be passed within the period stipulated.
