The petitioner is apprehending her arrest in connection with Falka P.S. Case No. 83 of 2017 registered for the offences punishable under Sections 371, 372, 373 and 120B/34 of the Indian Penal Code.

Allegation against the petitioner is that she had enticed away the daughter of informant and sold her to other accused persons and they have taken her to Rajasthan where one of the co-accused married her.

It has been submitted on behalf of the petitioner that petitioner is a married lady and has falsely been implicated in this case and earlier also informant has filed case against her. Heard learned APP also, who has opposed the prayer

Patna High Court Cr.Misc. No.36758 of 2017 (2) dt.18-08-2017 2/2 for anticipatory bail stating that in her statement under Section 164 Cr.P.C. the victim has supported the prosecution version. Having heard both sides and in the facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner.

Let petitioner surrender before the court below and pray for regular bail, which shall be considered on the basis of the facts as well as materials available on record, if possible, on the same day.

With the above observation, this application is dismissed.
