As has been submitted by the counsel for the petitioners that petitioner no. 3, Mangal Yadav has been arrested and, as such, this application has become infructuous with respect to petitioner no. 3.

In such view of the matter, this application is dismissed as infructuous with respect to petitioner no. 3. So far petitioner no. 1 and 2, they are seeking anticipatory bail in connection with Rajoun P.S. Case No. 165 of 2019 registered for offence punishable under sections 147, 148,

Patna High Court CR. MISC. No.46127 of 2019(2) dt.25-07-2019 2/2 323, 307, 504, 379 and 506 of the Indian Penal Code. The incident has taken place on account of grazing of crops by the cattle. Both sides have altercated and caused injury to each other. Allegation against two persons, namely, Ranjit Yadav and Pappu Yadav is by and large general. No specific allegation allegation has been against them.

Looking to the facts and circumstances of the case, the petitioner no. 1 and 2, in the event of arrest or surrender before the court below within six weeks from today, are directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Rajoun P.S. Case No. 165 of 2019, subject to the conditions as laid down under section 438 Cr. PC and also subject to the condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. The petitioners will not induce any witness or tamper with the evidence. The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.
