Mr. Manoj Kumar APP ====================================================== CORAM: HONOURABLE MR. JUSTICE MADHURESH PRASAD ORAL ORDER 19-03-2021 Heard learned senior counsel for the petitioner and the learned APP for the State.

Learned senior counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by office when called upon to do so by the office. The petitioner seeks bail in Aurangabad Town PS Case No 346 of 2020 instituted for the offence under Section 306 of the Indian Penal Code.

The informant has alleged that the second wife of his father has committed the murder of his father. The facts stated in the prosecution case is that the victim has died while he was at the police line in the course of his service where he has been found hanging.

It is submitted by the learned senior counsel that her implication, later on is at the instance of the son merely on

Patna High Court CR. MISC. No.866 of 2021(2) dt.19-03-2021 2/2 a suspicion; that on account of subsisting dispute relating to property and pendency of Title Suit the murder has been committed. The medical evidence falsifies the entire prosecution case as the same has found the death due to hanging. The submission is that for some time the victim was under going depression, and as a result, he has committed suicide. The petitioner's implication is merely on suspicion and in such circumstances, she is in custody since 11.10.2020. The learned APP for the State has opposed the prayer for bail.

Considering the rival submissions, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Aurangabad, in connection with Aurangabad Town PS Case No. 346 of 2020, subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if she fails to do so on two consecutive dates, her bail bond will be liable to be cancelled.
