2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 302 and 328/34 of the IPC.
3. The case of the prosecution in short is that the petitioner was married to one Gunjan Devi in the year 2012. It is further alleged that she was subjected to cruelty by her in-laws. She was having three children out of the wedlock. It is alleged that the in-laws were regularly assaulting her. One Rohit informed the informant that the daughter of the informant has died due to consumption of poison.
4. Learned counsel for the petitioner has submitted that the marriage was solemnized in the year 2012 and there was no complain against the petitioner and from perusal of the post-
Patna High Court CR. MISC. No.45798 of 2025(3) dt.16-09-2025 2/2 mortem report it will transpire that the Doctor has opined that death may have been caused by ingestion of some poisonous substance. Learned counsel for the petitioner has further submitted that from perusal of the FIR it is clear that the informant was told that the deceased has died after consumption of poison. Petitioner is the husband. Learned counsel has further submitted that the petitioner is a man of clean antecedent and is in judicial custody since 30.10.2024.
5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Chandan (Anandpur OP) P.S. Case No. 177 of 2022 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Banka.
