ANJANA MISHRA ORAL ORDER 07-04-2017 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State Bank of India. It is submitted by learned counsel appearing on behalf of the State Bank of India that the application under OTS scheme submitted by the petitioners has now been accepted in toto and the amount which was required to be deposited, has already been deposited by the petitioners. Thus, the present application has now been rendered infructuous and may be disposed of in terms of the settlement arrived at by the parties.
Patna High Court CWJC No.1703 of 2012 (11) dt.07-04-2017 P2/2 Learned counsel for the petitioners, however, submits that original documents of the petitioners' which stands as security with the State Bank of India, may now be returned to them and the case which was filed against them before the Debt Recovery Tribunal may be withdrawn as the Bank has now accepted their offer under the OTS scheme.
Be that as it may, such actions are a natural corollary to the compromise arrived at between the parties and it is expected that the Bank shall follow its actions in the same manner preferably within a period of four weeks.
With the above observations, the present application stands disposed of.
