The petitioner apprehends her arrest in Nathnagar (Madhusudanpur) P.S. Case No. 371/2016, registered for the offences punishable under Section 30(A) of the Bihar Prohibition & Excise Act, 2016.
Country made liquor was recovered from the house of the petitioner and others.
It appears that anticipatory bail petition of similarly situated co-accused namely, Jeera Devi and another has already been disposed of vide order dated 09.02.2017. Considering the facts aforesaid and the fact that there is recovery of liquor from the house of the petitioner, I am not inclined to enlarge the petitioner above-named on anticipatory
Patna High Court Cr.Misc. No.18279 of 2017 (3) dt.10-07-2017 2/2 bail. Accordingly, the same is rejected.
If the petitioner surrenders in the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail, learned court below shall consider the prayer for regular bail of the petitioner taking into consideration that small quantity of liquor was recovered and dispose of the bail petition on the same day.
