After some argument, learned counsel for the petitioner submits that he be granted liberty to prefer appeal against the impugned order dated 01.10.2020, passed by the Sub-Divisional Officer-cum-Licensing Authority, whereby the petitioner's licence to run a fair price shop under Bihar Targeted Public Distribution System(Control) Order, 2016 has been

In the facts and circumstances, this application is disposed of with a liberty to the petitioner to prefer appeal. If the petitioner prefers appeal within four weeks from today, the Appellate Authority shall be required to consider the petitioner's appeal on merit without going into the question of limitation, keeping in mind the fact the petitioner was pursuing his remedy before this Court by filing the present writ application. It is observed that the Appellate Authority is expected to dispose of the appeal as expeditiously as possible, within the period prescribed under Bihar Targeted Public Distribution System(Control) Order, 2016.
