JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-02-2019 Heard Sri Premchandra Yadav, learned counsel for the petitioner, Sri Shailendra Kumar Jha, learned counsel for the informant and learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Mahila P.S. Case no. 27 of 2018, registered under Sections 341, 342, 506/34, 376 and 313 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner has performed Nikah with the informant, namely, Najish Parveen and both are residing happily. On the other hand, learned counsel appearing for the informant submits that informant has already performed Nikah with the petitioner and there is no dispute between them. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the

No.54614 of 2018(4) dt.13-02-2019 2/2 event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Mahila P.S. Case No. 27 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
