====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 11-07-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offence under Sections 386,504 of the Indian Penal Code and Section 25(1-B)a, 26,35 and 37(b) of the Arms Act.

Co-accused Birkesh Kumar from whose possession a loaded country made pistol was recovered, has already been allowed bail by a coordinate Bench of this Court vide order dated 04.07.2019 passed in Cr. Misc. No. 41389 of 2019. Considering the fact that the petitioner has no criminal antecedent. He is in custody since 13.03.2019, nothing was recovered from possession of the petitioner, let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Sour Bazar P.S. Case No. 80 of 2019, with following conditions: (a) Both the bailors shall be the resident of territorial
