Counsel for the State and the State Election Commission are present and inform that an FIR was instituted on 18.4.2013 giving rise to Belchhi P.S. Case No.18 of 2013 in the light of the direction issued by the State Election Commission.
Mr. Himanshu Kumar, learned Assisting Counsel to Government Pleader No.1 informs that the restraint order issued by this Court was only on 29.4.2013 and much prior thereto the FIR was instituted.
Since the FIR has already been instituted and the order passed by the Commission has already taken its effect nothing survives for consideration in this writ petition which is
