The petitioners seek bail in a case registered for the offences under Sections 364, 363 and 34 of the Indian Penal Code. Jag Narain Singh, the informant, disclosed that when he woke up at 2.00 A.M. in the night, he did not find his granddaughter Manchan Kumari by his side. He made inquiry from his daughter-in-law.The informant suspected that his neighbours Keshari Singh, Rajeshwari Singh and Pintoo Singh on account of enmity might have kidnapped his grand-daughter with an intention to kill her.

Learned counsel for the petitioners submits that there

Patna High Court Cr.Misc. No.41984 of 2014 (4) dt.13-02-2015 is no eye-witness of the occurrence and only on suspicion, names of the petitioners figured in the case.

On the other hand, learned counsel for the informant, while opposing the prayer for bail, submitted that all the witnesses have supported the prosecution case, but he failed to point out from the case diary that any body had seen taking away the granddaughter of the informant. Considering the fact that on mere suspicion the names of the petitioners figured in the case, the petitioners, named above, are directed to be enlarged on bail on furnishing bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar, in connection with Dhansoi P.S. Case No.81 of 2014.
