The petitioner seeks bail in Murliganj P.S. Case No. 121 of 2015, instituted for the offence under Section(s) 366A/34 of the Indian Penal Code.

Counsel for the petitioner submits that victim is married lady. She has given statement under Section 164 Cr. P.C. wherein she has stated her age as 19 years. The court below has assessed her age to be 17 years. She has stated in her statement recorded under Section 164 Cr. P.C. that petitioner along with three persons took her to Bhargama and kept her for one night. They did not commit any illegal act with her. From the statement of victim girl recorded under Section 164 Cr. P.C. it appears that she had gone with the

Petitioner is in custody since 2.4.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura, in connection with Murliganj P.S.
