Petitioner seeks bail in Agiaobazar P.S. Case No. 44 of 2013 registered under section 302 and other allied sections of the Indian Penal Code.

Omprakash Singh lodged the case for murder of Mahanth Shiv Narayan Das and theft of idol of Shri Ramjanki Laxmanji against unknown.

Learned counsel for the petitioner submits that the petitioner is not named in the first information report. The name of the petitioner has figured in the confessional statement of Binay Pathak. Except the confessional statement nothing has been recovered from the possession of the petitioner. It appears that

Patna High Court Cr.Misc. No.41996 of 2014 (3) dt.09-02-2015 2/2 except the fact that the name of petitioner figured in the statement of co-accused and police did not collect any tangible evidence to show the involvement of the petitioner. Petitioner is in jail since 25.05.2013.

Considering the aforesaid facts the above named petitioner is directed to be enlarge on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Additional Sessions Judge, Vth , Bhojpur at Ara in S.T. No. 446 of 2013 arising out of Agiaobazar P.S. Case No. 44 of 2013.
