Heard learned counsel for the petitioners and the State.

The petitioners seek bail in a case registered for offences punishable under Sections 498(A) and 302 of the Indian Penal Code.

It has been submitted that the case has been registered under Sections 498(A) and 302 of the Indian Penal Code on the basis of a report of Ram Sakhi Devi whose daughter Meera Kumari was married 14 years earlier with late Shailendra Sah. After the death of her husband, it is

Patna High Court Cr.Misc. No.42083 of 2014 (2) dt.21-01-2015 2 / 2 alleged, that she was being tortured by her in-laws including the petitioners. Ultimately, she was found dead. It is submitted that the post-mortem report shows that the death was due to forced abortion attempt. Learned counsel submits that other co-accused person, Mahendra Sah, Bhairo Sah and Kishuni Devi have already been granted bail. It is contended that the petitioner no.1 is stranger to the family, whereas, petitioner nos.2 and 3 are "gotni' and petitioner no.4 is 'nanad' of the deceased.

Having regards to the facts and circumstances of the case, all the four petitioners, namely, Shail Devi, Lalita Devi, Lalita Devi and Guddi Kumari are directed to be released on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Pipra Case No.217 of 2012.
