The petitioner seeks bail in Mansi P.S. Case No. 213 of 2020, registered for the offence punishable under Sections 393, 353, 307 and 34 of the Indian Penal Code and u/s 27 of Arms Act.

As per the FIR, all the accused persons are alleged to have fired upon the police officials, as a result of which some of the police officials got injured and glass of government vehicle got damaged. They also obstructed public servant in discharging the official duty.

It is submitted on behalf of the petitioner that

Patna High Court CR. MISC. No.56830 of 2021(3) dt.31-01-2022 2/2 petitioner has falsely been implicated in this case. Specific allegation of firing is against co-accused Nitish Kumar. There is general and omnibus allegation against this petitioner and no specific overt act has been alleged against this petitioner. Petitioner claims clean antecedent and is in custody since 15.10.2020 and investigation in this case is complete. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Khagaria in connection with Mansi (Supplementary) P.S.
