The petitioner apprehends his arrest in connection with Fatehpur P.S. Case no. 268 of 2018, registered under Sections 341, 323, 504, 308 and 379/34 of the Indian Penal Code.

The accusation is that on 06.09.2018 at about 10.00 P.M., due to family dispute, petitioner started abusing to the informant and caused injury through lathi at his forehead then informant fell down on the ground. When wife of the informant rushed to save him then she was also assaulted by Manti Devi.

Learned counsel for the petitioner submits that scuffle took place due to land dispute in which informant

Patna High Court CR. MISC. No.44802 of 2019(2) dt.22-07-2019 2/2 sustained simple injury, but with ulterior motive the informant lodged the present case with false allegation. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M-X, Gaya in connection with Fatehpur P.S. Case No. 268 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
