2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 363,365,364,302,120B/34 of the Indian Penal Code.

3. As per the prosecution case, on 23.11.2020 at 7 pm informant's son went to the shop for purchasing biscuit but he did not return. On 5.12.2020 his dead body was recovered from the field.

4. Learned counsel appearing for the petitioner submits that the FIR is against unknown. There is no eye witness to the occurrence. The only material that has come during investigation is that prior to the alleged occurrence, informant had negotiated disposal of land of one Mahesh Mahto in which petitioner and other accused persons had threatened the informant of dire consequences. Considering the fact that except suspicion, no other substantive evidence has come against the petitioner to show his complicity in the alleged offence, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in Dumra Police Station Case No. 378 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
