2. The petitioner is seeking bail in connection with Araria P.S. Case No. 495 of 2024, registered for the offence under Section 8/21(b) of the N.D.P.S. Act.

3. As per the allegation, the house of co-accused Sunita Devi and Ravi Shankar Kumar @ Bholam was searched and altogether 100 grams of smack like substance was recovered.

4. Learned counsel for the petitioner has submitted that the petitioner is not named in the F.I.R. and the name of the petitioner surfaced in this case on the basis of statement of coaccused Ravi Shankar Kumar @ Bholam before police while in

Patna High Court CR. MISC. No.45415 of 2026(2) dt.08-07-2026 2/3 police custody, which has no evidentiary value in the eye of law. It has further been submitted that the other material against the petitioner is that he had talked ten times on phone with coaccused Ravi Shankar Kumar @ Bholam, which is not an unusual one. It has further been submitted that co-accused Ravi Shankar Kumar @ Bholam has been granted the privilege of bail by order dated 23.04.2025 passed in Cr. Misc. No. 20617 of 2025, while co-accused Sunita Devi, mother of co-accused Ravi Shankar Kumar @ Bholam, has been granted the privilege of bail by a co-ordinate Bench of this court by order dated 05.02.2025 passed in Cr. Misc. No. 89520 of 2024.

It has further been submitted that the alleged recovery is much less than the commercial quantity and the weight of wrapper has also been calculated for the purpose of weighing the entire contraband article. It has further been submitted that although the petitioner has been made accused in nine cases, but he is on bail in those cases. It has lastly been submitted that the petitioner is in custody since 14.05.2026.

5. Learned A.P.P. for the State, vehemently, opposed the prayer for regular bail of the petitioner.

6. Heard the parties and perused the records.

7. Considering the facts and circumstances as well as

No.45415 of 2026(2) dt.08-07-2026 3/3 the nature of the material against the petitioner as also the parity, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned court of Sessions Judge-Cum-Special Judge, N.D.P.S. Act, Araria, in connection with Araria P.S. Case No. 495 of 2024.
