ANJANA MISHRA ORAL ORDER 17-08-2017 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered under Sections 304(B), 201, 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that initially charge sheet was submitted only against the husband (Subodh Yadav) of the deceased under Section 306 of the Indian Penal Code. However, cognizance in the present case has been taken against the husband and the petitioner under Sections 302, 201,306, 34 of the Indian Penal Code. The case was registered against Subodh Yadav and thirteen others, which included the petitioner. The petitioner is the first wife of co-accused Subodh Yadav and only for this reason the name of the petitioner has

Patna High Court Cr.Misc. No.35872 of 2017 (2) dt.17-08-2017 2/2 come in this case. It is further submitted that husband Subodh Yadav has been granted bail vide order dated 29.06.2015 in Cr. Misc. No. 13580 of 2015.

Considering the aforementioned facts, let the above named petitioner, in the event of her arrest/surrender in the court below within a period of three months from today, be released on bail on furnishing bail bond of Rs. 10,000/( ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sanjeev Kumar-II, learned Additional Chief Judicial Magistrate-v, Araria in Narpatganj P.S.Case No. 100 of 2009, subject to the conditions as laid down u/s 438(2) Cr.P.C.
