JUSTICE BIRENDRA KUMAR ORAL ORDER 29-07-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is languishing in custody for the offences punishable under Sections 409/420 of the Indian Penal Code.
The main allegation of non-transmission of rice equivalent to the paddy supplied to Gautam Mini Rice Mill is against its proprietor Pramod Pandey. Pramod Pandey was, under a written agreement with the Bihar State Food Corporation, to supply the milled rice to the food corporation on the terms and conditions mentioned therein.
Patna High Court CR. MISC. No.46046 of 2019(2) dt.29-07-2019 2/3 Allegation against the petitioner who was Circle Officer is that he submitted valuation report of the land of Pramod Pandey which was several times more than the actual value of the land.
Submission is that valuation of the land is given on the circle rate approved by the Government and no other criteria is adopted for reporting valuation of the land. Learned counsel for the Bihar State Food Corporation opposed the prayer for bail.
Considering the nature of allegation and completion of investigation against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Kudra P.S. Case No.56 of 2015, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below
