JUSTICE SATYAVRAT VERMA ORAL ORDER 07-01-2022 Heard the learned counsel for the petitioner and the learned APP for the State, through Video Conferencing. The petitioner seeks bail in connection with Barachatti Excise P.S. Case No.207 of 2021, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The learned counsel for the petitioner submits that the petitioner is in custody since 30.07.2021, he is a person with clean antecedent and prosecution report has been submitted in this case and allegation is of recovery of 450 litres of foreign liquor from a pick-up van, as detailed in the FIR. The learned counsel for the petitioner submits that the petitioner is the driver of the vehicle, as such, was not knowing

Learned A.P.P. opposes the bail application.

Considering the fact that petitioner is in custody since 30.07.2021, he is a person with clean antecedent, charge-sheet has been submitted, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.2,000/- (Two Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge 2nd -cum-Special Judge, Excise Act, Gaya, in connection with Barachatti Excise P.S. Case No.207 of 2021.

The application stands allowed.
