2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Sirdalla P.S. Case no. 28 of 2025 instituted for the offence under Sections 126(2), 115(2), 117(2), 308(5), 352, 351(2), 3(5) of the B.N.S.S.

4. As per allegation in the FIR, informant had given his house to accused Dinesh Saw to look after it as he resides in Kolkata. When he returned from Kolkata, then Dinesh Sao and Mukesh Sao assaulted him and demanded Rs. Three lac as rangdaari. Allegedly, petitioner, son of Dinesh Sao, has also assaulted the informant.

5. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.45355 of 2025(2) dt.21-07-2025 2/2 petitioner has submitted that petitioner is innocent and has committed no offence. Both parties are agnates and due to partition dispute, alleged occurrence took place. General and omnibus allegation has been levelled against the petitioner. It is evident from impugned order itself, that informant has received simple injury.

6. Learned APP appearing for the State has opposed the prayer of Bail.

7. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Sirdalla P.S. Case no. 28 of 2025, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Nawada subject to the conditions as laid down under section 482 of the B.N.S.S.
