JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 12-04-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offence punishable under Section 25 (1-a), 25 (1-aa), 25 (1-b), 26 (1) (2) (3) and 35 of the Arms Act.

The allegation against the petitioner is that he in association other persons is running an illegal mini gun factory and on raid several half built arms and other parts of the arms were recovered.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He is quite innocent and has been falsely implicated in this case merely on suspicion. No incriminating article has been recovered from his conscious physical possession rather one personal mobile was

Patna High Court CR. MISC. No.1010 of 2021(4) dt.12-04-2021 2/2 recovered from his possession. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. The petitioner has been languishing in custody since 29.06.2020.

Learned APP for the State vehemently opposing the bail petition submitted that considering the fact that the petitioner is involved in running mini gun factory he does not deserve bail.

In the facts and circumstances of the case and also considering the fact that the allegation is very serious in nature, I am not inclined to enlarge the petitioner on bail. The prayer for bail is hereby rejected at present.
